Lawful basis of our privacy policy

The data privacy policy of SpeakerHub is based on the provisions of the EU's General Data Protection Regulation (GDPR). Although this regulation only applies to protect EU citizens, we voluntarily extend the individual's rights granted under GDPR to apply to all of our customers, worldwide.

We use legitimate interests as the lawful basis for processing your data under the GDPR regulations.

So what are the legitimate interests?

SpeakerHub's legitimate interests are its business needs balanced against the rights and freedoms of all individuals affected by those needs. It incorporates considerations of the risks to you present in our processing, your likely response to those risks (unless you inform us of your actual considerations) and what benefits you are likely to receive from our processing.

SpeakerHub's legitimate interests are to attract speakers and event organizers to the Site in order to build a symbiotic environment of benefit to both. We offer resources, tools and aids to assist speakers in finding gigs and to assist event organizers in finding speakers and organizing events. We offer educational resources to speakers so that they can improve their skills. The business is based on the freemium model so speakers will enjoy a free service but with incentives to upgrade to a paid account. All services are free for event organizers.

The legitimate interests of customers are to have a place where speakers can find gigs and event organizers can find speakers. Speakers can also enjoy educational resources such as articles, podcasts and webinars. Some of these as a premium service. Both speakers and event organizers can utilize a free system that aids managing and communicating about speakers' applications to speak at events.

Risks to customers are considered mininmal, as all have self-enrolled, we handle their data securely and responsibly, and offer easy options to unsubscribe from any or all of the various methods of communication. We consider that we do not undertake any data processing or usage that customers would not reasonably expect.

What we do with your data

Your data may be used for the following purposes:

  • Providing the services you request: we use the information you give us to perform the services you have asked for in relation to your usage of the Site, for example publishing you speaker profile or event details;
  • Contacting you about services: we send you communications about the services we offer and any changes to such services;
  • Messaging: Other SpeakerHub users such as speakers and event organizers will be able to message you and vice versa;
  • Recommendations: You will receive an email notification when someone recommends your speaker profile;
  • Speaker Application Updates: You will receive updates about events you've applied for;
  • Event Comments: You will receive email notifications about comments on your events;
  • Profile Reminders: We will send you emails about making your speaker profile more robust.
  • Credit or other payment card verification/screening: we use your payment information for accounting, billing and audit purposes and to detect or prevent any fraudulent activities;
  • Security, health, administrative, crime prevention/detection: we may pass your information to government authorities or enforcement bodies for compliance with legal requirements;
  • Customer Services communications: we use your data to manage our relationship with you as our customer and to improve our services and enhance your experience with us;
  • Weekly Newsletter: We will send you our weekly newsletter, which includes links to articles and other resources such as podcasts and webinars about speaking-related topics that we believe will be of interest to you.

You will have the choice to opt in or opt out of receiving all the communications above by indicating your choice on the notification preferences page. You will also be given the opportunity on every e-communication that we send you to indicate that you no longer wish to receive our emails.

Your rights

You have the right to:

  • Request information about whether we hold personal information about you, and, if so, what that information is and why we are holding/using it.
  • Request access to your personal information (commonly known as a "data subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
  • Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).
  • Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.
  • Object to automated decision-making including profiling, that is not to be subject of any automated decision-making by us using your personal information or profiling of you.
  • Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
  • Request transfer of your personal information in an electronic and structured form to you or to another party (commonly known as a right to “data portability”). This enables you to take your data from us in an electronically useable format and to be able to transfer your data to another party in an electronically useable format.
  • Withdraw consent. In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another lawful basis for doing so.

You will not have to pay a fee to access your personal information or to exercise any of the other rights.

We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is an appropriate security measure to ensure that personal information is not disclosed to any person who has no right to receive it.

Security of your personal data

We follow strict security procedures in the storage and disclosure of your personal data, and to protect it against accidental loss, destruction or damage. The data you provide to us is protected using SSL (Secure Socket Layer) technology. SSL is the industry standard method of encrypting personal information and credit card details so that they can be securely transferred over the Internet.

Retention of your data

We will retain your information for as long as your account is active on our site in order to provide you with access to our service. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. If you are not active on our site and are not opening communications from us for a period of 2 years, we shall delete all your data from our system. We will email you at least 30 days before doing so, to give you the opportunity to request that we retain your data.

With whom do we share your data?

Your personal information will never be sold by us. Your personal information will not be passed to a third party except for those providing services to us.  For example, we may: i) provide email address data to a third party that we use for sending newsletters; ii) give access to web developers to improve our service; iii) give information to a third party for the purposes of processing credit card payments; and iv) any other similar uses by third parties providing services to us.

Billing and payment processors

For billing purposes, we require our customers to provide their full name and billing address. For payments through Stripe.com, payment information on customers' billing address shall be provided directly by the customer to us, while for payments made via PayPal, PayPal's policy is to forward the customers' billing address to us. Neither of these payment service providers discloses any information about customers' credit card details to us.

You are allowed to view, change or delete your personal information (including your billing address) by logging in to your account at the Site or contacting us at the address indicated above.

Cookies

Like most other sites, we use cookies.  Cookies are identifiers that we may transfer to your computer through your browser to enable us to recognize your browser.  Cookies tell us how and when pages on our site are visited and by how many people.  These cookies do not collect personal information.  We do not combine the information collected through cookies with other personal information to further identify you.

You may be able to turn off cookies through the settings on your browser.  However, we recommend that you leave the cookies activated while visiting our Site.  Cookies enable us to gain insight into what are the most attractive features of the Site and which features you prefer. 

Children’s Personal Information

The Site is designed for an adult audience and is not aimed at children under the age of 16. We do not knowingly collect or solicit personal information from children under the age of 16. If we become aware that we have collected personal information from a child under the age of 16, we will promptly delete the information from our records. If you believe that a child under the age of 16 may have provided us with personal information, please contact us as specified in the "Our contact information" section near the top of this document.

Other considerations

Like most websites, our servers use log files to list requests made by you to the server.  We use log files to store information such as internet protocol addresses, browser type, internet service provider, visited pages, date and time used and gather broad demographic information for aggregate use. This information is not linked to any personally identifiable information.

This Site contains links to other sites. We are not responsible for the terms of use or privacy practices of these other sites.  Use of those sites is governed by their own terms and policies.

We may allow outside companies to display ads on the Site. These ads may contain cookies whose data is collected by external advertising companies.

Whenever you voluntarily post information to the public profile you show on the Site, or the public comment areas on the Site or any other public forums, the information you post can be accessed by the public.  We are not responsible for any information that is disclosed publicly through the Site. 

We have the right, but no obligation, to monitor the Content you post on the Site. We reserve the right to remove any such information or material for any reason or no reason, including without limitation if, in our sole opinion, such information or material violates, or may violate, any applicable law or our Terms of Use, or to protect or defend our rights or property or those of any third party. We also reserve the right to remove information upon the request of any third party.

We have features where users of our Site can submit information to us. Where such submissions include requests for service, support or information, we may forward them to our agents, as needed, to best respond to the specific request. These agents may be located outside of the EU. In addition, we may retain e-mails and other information sent to us for our internal administrative purposes, and to help us serve customers better. Users can request the deletion of any communication with us, unless we are required by law or due to legal interests to maintain such correspondence.

Customers subscribing to our Services receive service-essential messages at the e-mail address they have provided to us. These messages are strictly limited to communication necessary to use our services. For example, we send new users an automated message with their username and password and send an automated message confirming customers’ purchases, etc.

In addition to such service-essential messages, we offer our customers the option to receive information about us, our products, services and special offers. However, such information is only sent to users who have explicitly authorised us to send them such information in accordance with the double opt-in method.

Copyright infringement notification

If you believe that any Content (as defined in the Terms of Use) violates your intellectual property rights, you should contact us immediately and include substantially all of the following information: 

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.

  2. A description of the copyrighted work that you claim has been infringed, or if there are multiple works, a representative list of the works. Please note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a file infringes your copyrights.

  3. A description of the material that you claim is infringing and information sufficient to establish where it is located on the Site.  The easiest way to allow us to find the material quickly is to provide the complete URL associated with each file, image or video.

  4. Information that allows us to contact you such as your address, telephone number, and email address;

  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and,

  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. The information provided by you may be forwarded to the person who provided the allegedly infringing content. 

We do not condone posting, reproduction or distribution of material by anyone other than the owner, copyright holder or the copyright holder's authorized agents.

Changes to our privacy policy

We may make changes to this Privacy Policy from time to time for any reason. Use of information we collect is subject to the Privacy Policy in effect at the time such information is used or collected. If we make changes in the way we use your personal information, we will notify you via e-mail or by posting an announcement on the Site. You are bound by any changes to the Privacy Policy when you use the Site after the first notification that changes have been posted.
