In the last couple years, several court decisions have invalidated many of the termination provisions that employers regularly used. This presentation briefly reviews the recent cases on termination provisions and then suggests some proactive strategies to address these issues in your workplaces.

Employers often put restrictive covenants, such as non-competition or non-solicitation clauses, into their contracts as a matter of course. However, courts take a very strict view of enforcing such clauses. This presentation reviews considerations of when such clauses are appropriate and of how they should be drafted.
